Contact Point of the .pl domain name Registry for the DSA matters (authorities)

GENERAL INFORMATION

  1. Acting under Article 11 of the Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on the single market for digital services and amending Directive 2000/31/EC (Digital Services Act) ("DSA") Naukowa i Akademicka Sieć Komputerowa - Państwowy Instytut Badawczy in Warsaw, which maintains the .pl domain Registry („Registry”), has designated a single point of contact ("Contact Point") enabling the authorities of the Member States and the Commission and the Board for Digital Services to communicate directly, by electronic means, with the Registry for the application of the DSA.

  2. The Contact Point handles orders to act against illegal content under Article 9 of DSA and orders to provide information under Article 10 of DSA, issued to the .pl domain Registry by relevant national judicial or administrative authorities on the basis of the applicable laws (hereinafter collectively: „DSA Orders”).
  3. The Contact Point provides service in both Polish and English.

ELECTRONIC COMMUNICATION CHANNELS

  1. Due to the required communication security:

    1. The Contact Point accepts correspondence signed in accordance with applicable legal provisions, submitted via the ePUAP platform to the following address: /NASK-Instytut/SkrytkaESP (please add the annotation: „correspondence to the .pl domain Registry”); further correspondence in the case may also be conducted using the contact details indicated by the authority in the DSA Order or other appropriate letter;
    2. Authorities unable to use the ePUAP platform shall forward correspondence signed in accordance with the applicable legal provisions, in particular bearing a qualified electronic signature or a qualified electronic seal, referred to in Regulation (EU) No. 910/2014 of the European Parliament and of the Council of 23 July 2014 on electronic identification and trust services for electronic transactions in the internal market and repealing Directive 1999/93/EC (so-called eIDAS); correspondence signed in this way should be sent to the e-mail address: info@dns.pl;
    3. Authorities of countries other than Poland may send the correspondence also through the Polish authority, in accordance with the relevant regulations and arrangements between the authorities.
  2. Omission of communication security procedures may lead to delays in service or prevent it from being taken effectively.

SCOPE OF SERVICE

  1. The Contact Point only serves the authorities and matters referred to in sections 1- 2 above. The Contact Point is not provided to handle other matters. Entities other than authorized bodies shall contact us as part of standard procedures, following the information on the dns.pl website.

  2. Each .pl domain name is assigned its Registrar, whose details may be found in the official Whois database at https://www.dns.pl/en/whois and in the list of .pl domain Registrars at https://www.dns.pl/en list_of_registrars. The Contact Point does not handle correspondence to the Registrars, referred to in the DSA, nor correspondence addressed to these entities regarding their other activities (e.g. provision of hosting, websites operation, etc.). The Contact Point is not an intermediary in such correspondence.

  3. The Contact Point does not handle correspondence not pertaining to the .pl domain Registry, regarding names in domains other than .pl (e.g. .com, .eu, .de, etc.), nor regarding subdomains (lower level domain names), with the exception of names created directly in the so-called regional domains (https://www.dns.pl/en/list_of_regional_domain_names) and functional domains (https://www.dns.pl/en/list_of_functional_domain_names).

ORDERS UNDERT ART. 9 OF DSA

  1. According to recitals 28-29 of the DSA, the services of top-level domain name registries are mentioned in relation to the category of "mere conduit", covered by the article 4 of DSA. The Registry only provides DNS services for the .pl domain, in accordance with the Regulations available at (https://www.dns.pl/en/pl_domain_name_regulations). These services do not constitute hosting within the meaning of the Article 6 of DSA, and the Registry is not, in particular, a provider of online search engines, a provider of online platforms, or a provider of other hosting services.

  2. Due to the conditions of the worldwide DNS system, of which the .pl domain is a part, the interruption of the DNS service by the Registry:

    1. results without territorial restrictions and in its entirety, i.e. without the possibility of separating illegal content from other content;
    2. affects the domain name Registrant and other entities using it, and also extends to technically related services, including all e-mail addresses in the domain name;
    3. does not technically result in preventing access to or the removal of content from web pages, websites, online platforms, etc., or from online search engines.
  3. Given that the selection of legal resources, referred to in Article 9 of DSA, is made by the relevant authorities, the Registry, when handling the DSA Orders, assumes that the authorities issuing such Orders have carried out a prior analysis of the proportionality and necessity of their application to the .pl domain name, including taking into account the technical conditions indicated in section 10 above and any potential consequences thereof.
